Uniform Child Custody Jurisdiction & Enforcement Act

The Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) was designed to deter interstate parental kidnapping and to promote uniform jurisdiction and enforcement provisions in interstate child custody and visitations cases. The UCCJEA is a uniform state law that all states can adopt to deter interstate parental kidnapping.

Involuntary Commitment of an Individual

Involuntary commitment of an individual occurs when the individual is ordered to a treatment facility or hospital to prevent them from harming themselves or others. In order for one to be confined against their wishes they must be mentally ill, under the influence of an intoxicant or narcotic, or a danger to themselves of others.

Child Custody and Religion

Religion is usually not an issue in child custody proceedings, even if the parents practice different religions. For example, if a child has a Christian mother and a Jewish father, a court will not consider the merits of either religion in determining which parent should have custody of the child. The court will grant custody to one parent, or joint custody to both parents, and the child will be exposed to both the mother's religion and the father's religion.

Incestuous Marriages

An incestuous marriage is a marriage between close family members. The validity of an incestuous marriage depends on the law of the state where the parties intend to reside. In the state where the incestuous marriage is regarded as a crime, the incestuous marriage is not accepted for immigration purposes even if the marriage was legally contracted somewhere else.
